General Terms and Conditions

1. Scope

These General Terms and Conditions apply to all transport and forwarding services of Ruf Schwertransporte.

2. Contractual Basis

Services are provided exclusively according to the latest version of the German Freight Forwarders’ General Terms and Conditions (ADSp).

3. Services

The scope of services is defined in the respective order.

4. Prices and Payment

All prices are net plus VAT. Invoices are payable within 14 days.

5. Obligations of the Principal

The principal must provide complete and correct information about the goods.

6. Limitation of Liability

Liability is governed by ADSp. Clause 23 limits liability to EUR 5/kg according to Art. 431 HGB and to 2 SDR/kg for multimodal transport including sea carriage. Liability is further limited to EUR 1 million per damage or EUR 2 million per event or 2 SDR/kg, whichever is higher.

• Clause 27 ADSp does not extend liability beyond statutory regulations.
• The forwarder as sea carrier is liable only for its own fault.
• The forwarder under CMNI is exempt from liability under statutory conditions.

7. Insurance

Transport insurance is arranged only upon request and at the expense of the principal.

8. Jurisdiction

Place of jurisdiction is the registered office of the forwarder. German law applies.
